Inspirational Speakers Booking Terms
1.These Terms are those under which the Personality shall be engaged by the Client and they will apply to this engagement, unless otherwise agreed at the time of the engagement.
2.In all engagements and transactions the Personality is the principal and the Manager acts on behalf of the Personality. The Manager is not itself a party to these Terms and accordingly will not be liable for any default of either party whatsoever. Save in respect of death or personal injury any liability of any party to the other shall not exceed in total an amount equal to the amount paid by the Client under this Agreement.
3.The Personality undertakes to use his/her best endeavours to fulfill the obligations as detailed herein.
Fees
4. Deposit payments should be made to the Manager within 30 days of date of invoice. Balance of fees and expenses with 30 days of date of invoice.
5. All payments should be made to the Manager within 30 days of date of invoice.
6.If full payment of an invoice is not made on the due date then interest shall thereafter be payable on the outstanding balance at the rate of 4% above the National Westminster Bank Plc base rate from time to time in force until payment.
7.In the event of cancellation by the Client less than [3] months prior to the date of the engagement, a cancellation fee of 75% of the fee shall be payable by the Client.
8.In the event of cancellation by the Client less than [2] weeks prior to the date of the engagement, a cancellation fee of 100% of the fee shall be payable by the Client.
Copyright
9. The Client understands that it will not own the copyright in any literary works produced by the Personality, nor any photographs of the Personality nor will it use any copyright works belonging to the Personality or the Manager without receiving either party’s written consent.
Data Protection
10. Each party shall comply with all laws and regulations relating to data protection and with all guidelines and guidance issued from time to time by the appropriate regulatory authorities as the same relate to each party’s position as a data controller/processor.
General
11. Arrival and departure times are not part of this contractual agreement and serve only as a guide to the speaker
12.Unless otherwise agreed all travel will be business /first class and executive accommodation will be provided
13. The client undertakes to provide; a suitable venue, properly lit heated and ventilated. The Client will provide the necessary technical support such as staging and sound equipment in good working order to enable the Celebrity to carry out his or her services. Suitable insurance including adequate public liability and ensure that all regulations met in respect of the venue for fire, safety and any other statutory regulations and ensure that the maximum capacity for the venue is not exceeded.
14.Whilst we take every care to ensure the suitability of a Speaker for the engagement, Creating Excellence does not accept responsibility for the choice of speaker and is not liable for costs and damages that may arise.
15.No audio or video recording (including back projection) of the speaker may be made without the prior consent of Creating Excellence
16.For a period of 6 months after the date of this agreement the client agrees not to contact the speaker direct. The Client agrees to refer all enquiries, including from delegates attending the event, to Creating Excellence.
